Poe said a gun was levelled at him that night and afterwards it was cross referenced by several people as a self -cocker because such a gun would have been quite a novelty in 1881 New Mexico...John Poe must have been everything Pat Garrett was supposed to be - a very fine upstanding lawman an citizen throughout his life.. admired by Charles Goodnight and elected Sherriff of Lincoln County in 1885 after defeating Pat Garrett's choice - James Dolan.. I dont want to offend anyone by saying this, but the more I learn about Pat Garrett the more he disapoints me, how come a lawman with a reputation like Garrett back up a non convicted murderer like Dolan? This is one of is bad choices he made in is life that I didnt know about...

The election of Pat Garrett in 1880 as sherriff of Lincoln may have been staged by Chizum but could not have happened without co-operation with Dolan who also wanted BTK eliminated...voter turn out was 110% --the next election in 1882 when Garrett quit -was of no interest to Chizum and Garrett supported Dolan because of his political connections which came to nothing after Dolan lost to Poe in what must have been a fair election.

Let's assume that Pat Garrett did kill Billy the Kid, who was basically unarmed with the exception of the butcher knife to cut the beef. The real question ought to be, whatever happened to Billy The Kid's guns?
It's not mentioned one iota whether he was buried with his guns or not. There's not one single mention of where his guns were at in Maxwell's house. There's not even a mention of Garrett or anyone else taking momento's from The Kid.
It's ironic, at least to me, that Garrett's family still has the gun that allegedly killed Billy The Kid. Yet, you'd think Garrett would have wanted those weapons of Billy's to at least be some sort of proof he killed Billy The Kid in order to collect the reward money.
Port de Luna, for example, brag about having the fiddle that Billy The Kid allegedly played whenever he was staying there. You'd think a place like Fort Sumner would've come forward saying they had the guns. The Maxwell's claim to still have the bench Billy's body allegedly was on before he was buried, yet nobody has come forward saying they have Billy's guns.
So what are we to conclude? Either the Maxwell's have it, or, The Kid was buried with it, or, maybe just maybe someone else died that night and Billy The Kid left town with his weapons.

And his horse, saddle, bridle. This has always been a big point with me too. It goes against human nature to ignore such items and things. I'm reminded of when Bonny and Clyde were killed and the car was towed through town. People were trying to reach in the car and collect the blood on handkerchiefs. They were attempting to get anything they could. I believe somebody even tried to cut off one of Clyde's fingers. Could be wrong on that, though.

BTK also left Fort Sumner with the two single action 44 pistols from the Courthouse armoury in Lincoln ...Garrett left town with a suspect Coroners' verdict and a double action Colt that was claimed to have been in BTK 's hand when he was shot. For good measure he later added a saddle when auctioning Billy's belongings in Lincoln and the idea Pete Maxwell identified BTK before a shot was fired - which would have been an improvement on his shootings of the last two Regulators killed.No wonder Maxwell stayed quiet until he died. .taking with him a few other truths as well

Wayne, I think you need to read Garrett's and Poe's books. Poe said that "it seemed to me that he was fastening his trousers as he came toward me." Poe sat on the edge of the porch in the samll open gateway and McKinney sqatted on the outside of the fench. Poe stated that Billy came to almost within arm's length of where he sat before he saw Poe because he was partially concealed form his view. Poe also thought it was Maxwell or some one staying at Maxwell's house and did not think it was Billy. When Billy saw Poe and McKinney, he covered me with his six-shooter as quick as lightning. I don't know if you have ever looked down the barrel of a gun, I know I have and I had a gun on me. Poe did the only thing he could do. He told him they were not there to hurt him and didn't go for his gun. If he or McKinney had, Billy would have shot them. Another thing is they all thought they heard three shots that night and I feel they did. I think Billy got off a shot that hit the head board. Garrett kept the .41 Colt Thunderer and it was later sold to Billy Burt in Lincoln. I have a copy of the document where Garrett was told to put it up for sale. The other thing that Brushy people keep saying is what Poe said. Pat, the Kid would not come to this place; you have shot the wrong man. Poe did say that but here is the rest of the statement. Garrett said, That was the kid that came in there onto me, and I think I have got him. Garrett seemed to be in doubt himself as to whom he had shot, but quickly spoke up and said, I am sure that was him, for I know his voice too well to be mistaken, This remark of Garrett's relieved me of considerable apprehension. He said a lot more but you need to read it. Don't you also think that when the different people saw Billy and reacted as they did, Poe being a lawman would have known it was in fact Billy? Another thing that Brushy people like to say is Billy was placed in the carpenter shop and that the inquest said that they went to a room in Maxwell's house. Maxwell owned the carpenter's shop, it was a room so don't you think they may have said they went to room in Maxwell's house? In saying all of this, my answer is Billy did have a gun on him that night. It was a Colt .41 Thunderer that he had traded a Chisum cook for down on the Pecos because Billy had small hands and liked the feel of the pistol. I am sure he still had a .44 Colt with him also but the Thunderer was a smaller frame pistol and he didn't want to put his holster back on and stuck the pistol in his pants. This might be why Poe said it seemed like Billy was fastening his trousers. There’s one small issue.. The .44 in question has never surfaced anywhere in history. We have the one found in the tree, but none found on Billy, the internet or the auction block. Garrett supplied an accurate list of what’s missing, right down to their serial numbers. And while plausible, why is the 2nd .44 never located? Either it’s rusted away in the desert, or is tucked away forgotten in a drawer, but wherever it is, it never appeared again.
