Brushy and Morrison arrived at Mabry’s mansion upon entering the conference room were shocked at what they saw. Present in the room were several photographers and reporters, armed policemen, Oscar and Jarvis Garrett (Pat’s sons), Cliff McKinney (Kip McKinney’s son), Arcadio Brady (William Brady’s grandson), and historians William Keleher, E. B. Mann, and Will Robinson. In short, the private meeting had developed into a media circus. Badly frightened, Brushy apparently suffered a small stroke, and when the questioning began, he failed miserably. However, the men asking the questions seemed to treat the affair as something as a joke, and asked primarily only meaningless questions (i.e. how many girlfriends he had, did he enjoy stealing livestock, etc.). He completely forgot basic information about himself , and, when he was asked a serious question regarding the past of Billy the Kid, he forgot that as well. Stating he felt ill, he was eventually taken to another room to lie down. I agree! If he'd been a fraud he wouldn't have been affected so much by the circumstances as to bring on a stroke or heart attack or whatever it was. Also, the report from Morrison and others that heard the tapes of his interviews with Morrison that he broke down in tears a number of times while telling the story. And that when Morrison took him to Lincoln and wanted to go into the Courthouse he was overcome emotionally and at first refused to go in. All these things sound like a man who was telling the truth.
Brushy is seen in a great many photos with his right hand slightly away from his body as if preparing to draw a pistol. In fact, several folks reported seeing him walk around the streets of Hico with that same pose. It is also said that one day in Hico, a mother whose small child was named Billy, yelled out "Billy!" as her little boy ran into the street. Brushy heard it, spun around to face her and made a move like he was going to draw a pistol.
However, I think in the photo you mentioned above, what you are seeing is Brushy holding a walking cane in his right hand. All the same, your point is correct.

For some reason, this photo makes me sad because Brushy (Billy) thinks that they going to hang him, sad because if he remained claim or if there was no reporters in the room, then hopefully he might have had his pardon.

I'll tell you what makes me more sad than anything else regarding Brushy. It is that history has refuted his claim and that so many who admire Billy's stand, courage, and legend, belittle him now just because he lived longer than they want to believe he did. When they bash Brushy, they're bashing their hero and they won't accept that fact. That's really sad.

Actually, Mr Wayne land, that incident did indded happen.
One day in 1943 or 1944, Brushy was walking down a street in Hico. Also walking down the street was a five year old boy and his mother. When the boy ran into the street and was almost hit by a car, the mother yelled out her son's name, Billy, loudly. Witnesses said that Brushy whirled around and reached for an imaginary pistol. After Brushy realized his name wasn't being called, he hurried away. Although this is not technically evidence in support of Brushy’s claim, and in no way connects him directly to Billy the Kid, it does indicate he was a man used to danger.
